whizzQ Consumer Terms of Use
Enterprise Legal Draft • Editable Working Copy Effective Date: September 15, 2026 Version: 2.0 Last Updated: September 15, 2026 These Consumer Terms of Use (“Terms”) govern access to and use of the whizzQ platform by consumers. whizzQ is operated by SCHEDMAD Private Limited (“SCHEDMAD”, “whizzQ”, “we”, “us” or “our”). By creating an account, accessing whizzQ, requesting or making a booking, using a whizzQ service, or otherwise using the Platform, you agree to these Terms and the policies incorporated into them. These Terms should be read together with: the whizzQ Privacy Notice; the Booking, Cancellation, Refund & Payment Policy; any offer-specific terms displayed on the Platform; any Merchant-specific booking or cancellation information displayed before booking; and any additional terms presented for a particular feature or service. If you do not agree to these Terms, you should not use whizzQ.
1. About whizzQ
whizzQ is a technology, scheduling and marketplace platform that enables consumers to discover and interact with independent businesses and service providers (“Merchants”). Depending on the Merchant and service, whizzQ may enable consumers to: discover businesses and services; view Merchant listings; view available dates or time slots; submit Booking Requests; receive appointment confirmations; make online payments; manage appointments; reschedule or cancel appointments; receive queue or token updates; receive appointment reminders; access Merchant offers; check in using QR or related functionality; and use other scheduling, marketplace or service-discovery functionality. Except where expressly stated otherwise for a particular offering, SCHEDMAD does not itself provide the underlying salon, healthcare, automotive, professional, hospitality, restaurant or other Merchant service booked through whizzQ. The relevant Merchant is responsible for providing the underlying service.
2. Definitions
“Auto Confirm”
means functionality that a Merchant may enable to authorise whizzQ to automatically confirm eligible Booking Requests based on the Merchant's configured availability and applicable settings.
“Booking Amount”
means the total amount shown as payable for the relevant booking before any subsequent cancellation, refund, adjustment or applicable deduction.
“Booking Request”
means a consumer's request to obtain a particular service from a Merchant at a selected or requested time. A Booking Request does not become a Confirmed Appointment until accepted by the Merchant or confirmed through Merchant-authorised Auto Confirm.
“Cancellation Charge”
means a charge configured by a Merchant that may apply when a Consumer cancels a Confirmed Appointment within the disclosed cancellation window.
“Confirmed Appointment”
means a Booking Request that has been accepted expressly by the Merchant or automatically through Auto Confirm previously enabled by the Merchant.
“Consumer”, “you” or “your”
means an individual who accesses or uses whizzQ in a consumer capacity.
“Merchant”
means an independent business, professional, service provider, outlet, branch or organisation offering services through or using whizzQ.
“Payment Processing Charge”
means any applicable transaction/payment-processing charge disclosed or applied in accordance with the relevant booking and payment terms.
“Platform”
means the whizzQ website, applications, marketplace, APIs, interfaces and related technology services operated by SCHEDMAD.
“Platform Fee”
means any applicable fee charged in connection with the whizzQ marketplace, booking or related Platform service.
“Service Disruption Voucher”
means a non-cash promotional voucher or discount benefit that whizzQ may issue in circumstances described in these Terms or the Booking, Cancellation, Refund & Payment Policy.
3. Relationship Between whizzQ, Consumers and Merchants
3.1 Independent Merchants
Merchants using whizzQ are independent third parties. Unless expressly stated otherwise for a specific offering: the Merchant provides the underlying service; the Merchant determines which services it offers; the Merchant determines its service pricing; the Merchant controls its operating hours and availability; the Merchant is responsible for its staff and facilities; the Merchant is responsible for maintaining licences, registrations and regulatory permissions required for its business; the Merchant is responsible for quality and fulfilment of the service; and the contract for performance of the underlying service is ordinarily between the Consumer and the Merchant. whizzQ provides technology and marketplace functionality to facilitate that relationship.
3.2 whizzQ's Role
Depending upon the particular functionality used, whizzQ may display Merchant information; provide marketplace discovery; facilitate Booking Requests; provide scheduling technology; transmit information between Consumers and Merchants; facilitate appointment confirmation; facilitate payment through authorised payment providers; calculate cancellation consequences using Platform rules and Merchant-configured parameters; initiate eligible refunds; provide communications and notifications; administer offers; and facilitate customer-support or dispute-management processes. These activities do not, by themselves, make SCHEDMAD the provider of the underlying Merchant service.
3.3 Intermediary Functions
To the extent that SCHEDMAD performs functions that qualify as intermediary services under applicable law in relation to third-party information, SCHEDMAD intends to operate those functions subject to the rights, protections, limitations and obligations applicable to such intermediary activity. Nothing in these Terms should be interpreted as representing that every whizzQ service or activity has the same legal character.
4. Eligibility and Capacity to Use whizzQ
You may use whizzQ only if you are legally capable of entering into the relevant transaction or are using the Platform with the involvement and authorisation of a person legally entitled to act on your behalf. You agree not to falsely represent your identity, create an account for fraudulent purposes, impersonate another person, use another person's payment instrument without authorisation, or use the Platform in violation of applicable law. Additional requirements may apply to particular services or Merchant categories.
5. Consumer Accounts
5.1 Registration
Some whizzQ functionality may require a registered account. You agree to provide information that is reasonably accurate and current.
5.2 Account Security
You are responsible for taking reasonable steps to protect your registered mobile number, email account, passwords, OTPs, devices and authentication credentials. You should promptly notify whizzQ if you reasonably suspect unauthorised use of your account.
5.3 One Person, One Authentic Identity
You must not intentionally maintain deceptive or fraudulent identities for the purpose of manipulating offers, making fraudulent bookings, evading restrictions, generating artificial ratings or reviews, or otherwise abusing the Platform.
6. Merchant Listings and Information
Merchant listings may include business name, location, operating hours, services, service descriptions, prices, availability, staff information, promotional offers, cancellation parameters, images, ratings, reviews and other information. Merchants are responsible for maintaining the accuracy of information supplied by them. whizzQ may perform reasonable checks, moderation or account-verification activities, but does not guarantee that every Merchant-provided statement is complete, current or error-free. If you identify inaccurate or misleading listing information, you may report it to help@whizzq.app.
7. Booking Requests
7.1 Submitting a Booking Request
When you select a Merchant, service, date, time or other booking parameters and complete the required booking process, you submit a Booking Request. A Booking Request is subject to Merchant availability, Merchant confirmation requirements, successful payment where online payment is required, applicable service restrictions, Platform validation and other conditions disclosed during booking.
7.2 Payment Does Not Necessarily Mean Merchant Acceptance
Where online payment is required, successful authorisation or capture of payment does not by itself mean that a Merchant has manually accepted the Booking Request. Unless Auto Confirm applies, Merchant confirmation remains required. If a Booking Request is not accepted, expires or otherwise fails in circumstances requiring refund, the applicable refund provisions will apply.
8. Appointment Confirmation
8.1 Merchant Confirmation
A Booking Request becomes a Confirmed Appointment when the Merchant accepts it.
8.2 Auto Confirm
A Merchant may enable Auto Confirm. Where Auto Confirm is active, an eligible Booking Request may automatically become a Confirmed Appointment where an applicable slot is shown as available, the Merchant's configured conditions are satisfied and the Platform successfully processes the booking. Auto Confirm operates pursuant to the Merchant's prior configuration and standing authorisation.
8.3 Confirmation Notification
Where practical, whizzQ will provide an in-app, SMS, WhatsApp, email or other appropriate notification indicating the confirmation status. Consumers should review the actual booking status shown in whizzQ rather than assuming that submission of a request alone guarantees acceptance.
9. Availability and Scheduling Information
Availability shown through whizzQ is based on Merchant schedules, staff availability, existing bookings, Merchant-configured capacity, Platform scheduling rules and relevant system information. While whizzQ aims to keep availability accurate, actual availability may be affected by Merchant configuration errors, delays in updating schedules, staff absence, operational emergencies, duplicate or concurrent activity, network failures, technical issues or circumstances beyond reasonable Platform control. A confirmed booking should ordinarily be honoured by the Merchant, subject to the cancellation and force-majeure provisions applicable to the booking.
10. Queue Times, Tokens and Waiting-Time Estimates
Certain Merchants may use whizzQ for token queues, real-time queue management, estimated wait times, check-in, walk-in management or service-progress updates. Queue positions, estimated service times and waiting-time estimates are estimates rather than guaranteed service times. Actual service time can be affected by duration of preceding services, emergencies, Merchant operational delays, late arrivals, staff availability, customer-specific service requirements and circumstances outside whizzQ's control. Where the Merchant operates a regulated or healthcare service, emergency or professional priorities may also affect the order or timing of service.
11. Online Payments
11.1 Payment Providers
Where online payment is available, payment processing is provided through authorised third-party payment infrastructure, which may include Razorpay and its relevant payment products. You may be required to accept the payment provider's own terms or privacy practices.
11.2 Payment Processing
whizzQ may create payment orders, receive transaction status information, verify successful payment, maintain payment records, administer applicable Platform Fees, facilitate Merchant settlement, initiate eligible refunds and administer disputes or reconciliation. Sensitive card, banking or payment credentials may be entered directly into payment-provider interfaces and may not be stored by whizzQ.
11.3 Razorpay Route
Where applicable, whizzQ may use Razorpay Route or equivalent marketplace payment functionality through which participating Merchants maintain linked payment accounts. Merchant amounts may be transferred or settled through the applicable payment infrastructure after the relevant service is marked Completed/Fulfilled, subject to the relevant payment, settlement and risk controls.
11.4 Payment Failures
A payment may fail because of insufficient funds, issuing-bank rejection, authentication failure, network failure, payment-provider failure, expired authorisation, security controls or technical error. whizzQ does not guarantee successful processing by independent banking or payment networks. If money is debited despite a failed transaction, reversal or refund timing may depend upon the relevant payment provider, bank, card network or payment instrument.
12. Cash / Pay-at-Merchant Bookings
Where a Merchant permits payment at the business location or another offline payment method: payment for the underlying service may be made directly to the Merchant; whizzQ may record booking or payment-status information; the Merchant remains responsible for issuing applicable tax invoices or receipts for its service; and disputes concerning amounts collected directly by the Merchant may primarily need to be resolved with that Merchant. Applicable whizzQ marketplace rules may nevertheless continue to apply to the booking.
13. Platform Fees and Payment-Related Charges
Where applicable, the booking interface may show charges associated with using the whizzQ marketplace or online-payment functionality.

A charge for applicable whizzQ marketplace or booking facilitation services.
Payment Processing Charge
An applicable charge associated with payment-processing functionality. The exact commercial treatment of such charges may depend upon Merchant plan, booking type, promotional arrangement, payment configuration and applicable whizzQ rules. Charges that affect a Consumer's refund will be applied only in accordance with the applicable Booking, Cancellation, Refund & Payment Policy and information presented in connection with cancellation.
14. Merchant Offers and Discounts
Participating Merchants may create promotional offers on whizzQ. Offers may be time-limited, service-specific, category-specific, subject to minimum-spend requirements, percentage based, fixed-amount discounts or subject to other disclosed conditions. Offers are subject to availability, validity periods, applicable Merchant conditions, service eligibility and applicable Platform rules. An expired offer has no continuing entitlement unless expressly stated otherwise. An offer reducing the payable amount to zero may result in a free booking without payment-gateway processing. whizzQ may correct a transaction where an offer was applied because of a manifest technical error, fraud or misuse, subject to applicable law.
15. Rescheduling
Where a booking is eligible for rescheduling, the Platform may allow the Consumer or Merchant to request or process a change to the date, time, service provider or relevant scheduling parameter. Rescheduling remains subject to Merchant availability, applicable Merchant rules, Platform functionality and any payment adjustment required by the change. A rescheduled booking remains subject to applicable cancellation rules. The relevant cancellation window may be assessed against the appointment time then applicable to the booking, as specified in the Booking, Cancellation, Refund & Payment Policy.
16. Consumer Cancellation
The detailed cancellation methodology is set out in the Booking, Cancellation, Refund & Payment Policy.
16.1 Unconfirmed Booking Requests
Where you cancel a Booking Request before Merchant confirmation, an eligible online-payment booking will ordinarily receive a full refund of the applicable amount in accordance with the Refund Policy.
16.2 Timely Cancellation of Confirmed Appointment
Where you cancel a Confirmed Appointment before the Merchant-configured cancellation-charge window begins, you will ordinarily be eligible for the refund specified in the Refund Policy.
16.3 Late Cancellation
Where you cancel a Confirmed Appointment inside the Merchant's disclosed cancellation-charge window, an applicable Cancellation Charge may be payable to the Merchant. Where applicable, the refund may be calculated as: Booking Amount less applicable Platform Fee less applicable Merchant Cancellation Charge = Consumer Refund Amount The exact amount that will be refunded should be displayed through the Platform before you finally confirm cancellation where that functionality is available.
16.4 Cancellation Charge
The Cancellation Charge is configured by the Merchant within Platform-supported parameters and is intended to address capacity reserved for a Confirmed Appointment that may no longer reasonably be capable of being reallocated. The applicable cancellation window, percentage or amount, and resulting refund will be determined in accordance with the applicable booking rules.
17. Merchant Cancellation or Rejection
17.1 Merchant Rejection Before Confirmation
Where a Merchant rejects an unconfirmed paid Booking Request, the Consumer will be entitled to an applicable full refund in accordance with the Refund Policy.
17.2 Merchant Cancellation of Confirmed Appointment
Where a Merchant cancels a Confirmed Appointment, the Consumer will ordinarily be entitled to a 100% refund of the amount actually paid for the booking, subject only to circumstances permitted by mandatory law or specifically disclosed exceptions that lawfully apply. The refund is returned to the original payment instrument through the relevant payment provider.
17.3 Late Merchant Cancellation and Service Disruption Voucher
Where a Merchant cancels a Confirmed Appointment during a period in which a Consumer cancellation would have attracted a Merchant Cancellation Charge, whizzQ's fairness standard is that the affected Consumer should receive, in addition to the applicable full cash refund, a Service Disruption Voucher. Unless a greater benefit is specified, the value of the Service Disruption Voucher will be at least equivalent to the Cancellation Charge that would have applied if the Consumer had cancelled the same Confirmed Appointment at that time. The Service Disruption Voucher: is a promotional benefit; is not a cash refund; is not a stored-value consumer wallet; cannot ordinarily be redeemed for cash; may be subject to an expiry period; may be subject to booking, Merchant, category or minimum-spend conditions; may be non-transferable; may be limited to one-time use; and is separate from the refund of the amount originally paid. The specific voucher conditions will be disclosed when the voucher is issued or made available. The provision of a promotional voucher does not limit any non-excludable statutory rights or remedies available to the Consumer.
18. Expired or Unattended Booking Requests
Where a paid Booking Request remains unresolved by the Merchant and expires without confirmation or fulfilment, whizzQ may automatically cancel or expire the booking. Where applicable, the Consumer will receive a full refund in accordance with the Refund Policy. whizzQ may separately enforce Merchant-side consequences under its agreement with that Merchant. Any Merchant-side penalty is independent of the Consumer's right to receive the applicable refund.
19. Refund Calculation Before Cancellation
For supported online-paid appointments, whizzQ may calculate the expected refund before cancellation is completed. The calculation may consider booking status, appointment date and time, Merchant cancellation window, Merchant Cancellation Charge, applicable Platform Fee and other applicable transaction parameters. You may be shown the expected refund and asked to confirm cancellation after reviewing it. If the displayed amount is affected by a manifest calculation, system or configuration error, whizzQ may correct the amount to reflect the applicable contractual and legal entitlement.
20. Refund Processing
20.1 Original Payment Method
whizzQ does not operate a consumer cash wallet. Eligible monetary refunds for online-paid bookings will ordinarily be initiated to the same payment method or original payment source used for the relevant transaction, subject to payment-provider functionality.
20.2 Processing Time
Once whizzQ successfully initiates a refund, the time required for the refund to appear in your bank account, card, UPI account or other payment instrument depends upon the payment provider and financial institution. An indicative processing period may be displayed in the Refund Policy or refund confirmation. Such periods are estimates unless applicable law requires otherwise.
20.3 Refund Records
whizzQ may maintain transaction information relating to refund amount, refund status, refund identifier, deductions, payment-provider response and associated booking.
21. No Consumer Wallet
whizzQ does not presently provide Consumers with a reloadable stored-value wallet for holding or withdrawing money. A promotional voucher, discount code, coupon, goodwill benefit or Service Disruption Voucher does not represent money deposited by the Consumer and should not be treated as a bank deposit, cash balance or withdrawable monetary account.
22. Merchant Service Quality and Fulfilment
Merchants are responsible for performing the underlying services booked through whizzQ. This includes responsibility for matters such as service quality, staff conduct, hygiene, professional standards, licences and registrations, safety, suitability of facilities, equipment, product quality, service duration, invoicing for the underlying service, Merchant warranties and compliance with laws applicable to the Merchant's business. whizzQ may take reasonable measures against Merchants that repeatedly fail to honour bookings, breach Platform policies or create material consumer risk. Such measures do not make whizzQ the provider of the Merchant's service.
23. Healthcare and Professional Services
whizzQ may facilitate appointments with doctors, clinics, hospitals, laboratories, diagnostic centres, consultants, professionals and other regulated service providers. whizzQ does not provide medical, diagnostic, legal, financial or other professional advice merely by facilitating such appointments. The relevant professional or Merchant is responsible for professional advice, diagnosis, treatment, prescriptions, professional decisions, regulatory compliance and service outcomes. The ordinary whizzQ booking interface is not presently intended as a clinical medical-record system. Consumers should not place diagnoses, clinical histories, prescriptions or medical reports in general booking fields unless whizzQ expressly introduces functionality designed to process such information. Nothing in these Terms limits liability that applicable law imposes directly upon a Merchant or professional.
24. Communications
24.1 Transactional and Service Communications
By requesting or managing a booking, you understand that whizzQ and/or the relevant Merchant may need to send communications reasonably necessary for that transaction. These may include OTPs, Booking Request messages, appointment confirmations, reminders, queue updates, rescheduling notices, cancellation notifications, payment confirmations, refund updates, security notifications and customer-support messages. Such messages may be sent through channels including SMS, WhatsApp, email, push notifications or in-app notifications.
24.2 Promotional Communications
Promotional communications are treated separately from essential service communications. Where consent or another legal requirement applies, whizzQ will seek the required permission before sending eligible promotional communications. You may withdraw applicable marketing consent without preventing communications reasonably necessary to administer active bookings, transactions, security or your account.
25. Ratings, Reviews and Consumer Content
Where whizzQ permits Consumers to submit ratings, reviews, photographs, comments, feedback or other content, you remain responsible for the content you submit. You agree that content must not knowingly be false or fabricated, impersonate another person, contain unlawful threats, infringe intellectual-property rights, unlawfully disclose another person's Personal Data, contain malicious software, constitute spam, promote fraud, be defamatory in violation of applicable law or otherwise violate applicable law or Platform policy. You grant SCHEDMAD a non-exclusive, worldwide, royalty-free licence to host, reproduce, display, format, moderate and use submitted content as reasonably necessary to operate, promote and improve whizzQ, subject to applicable privacy law. whizzQ may moderate, restrict or remove content where reasonably necessary for legal compliance, safety, fraud prevention, Platform integrity, rights protection or enforcement of these Terms.
26. Merchant Responses to Reviews
Merchants may be permitted to respond to consumer reviews. A Merchant response represents that Merchant's own content and opinion. whizzQ may moderate Merchant responses under applicable Platform rules.
27. Prohibited Conduct
You must not use whizzQ to: commit fraud; make deliberately false bookings; repeatedly reserve slots without genuine intent to attend; manipulate availability; attempt unauthorised payments; abuse refund or cancellation systems; exploit promotional offers dishonestly; scrape or systematically extract Platform information without authorisation; use bots or automated tools contrary to Platform rules; interfere with Platform security; reverse engineer protected portions of the Platform except where expressly permitted by law; introduce malware or harmful code; impersonate another person; harass Merchants, consumers or whizzQ personnel; obtain Personal Data unlawfully; infringe third-party intellectual-property rights; manipulate reviews or ratings; use the Platform for unlawful goods or services; or otherwise materially abuse the Platform.
28. Fraud, Abuse and Booking Manipulation
whizzQ may use manual or automated controls to identify suspicious activity. Where there is reasonable evidence of fraud or abuse, whizzQ may restrict particular transactions, cancel suspicious Booking Requests, restrict promotional eligibility, temporarily suspend an account, request additional verification, prevent payment activity, preserve relevant evidence or take other proportionate protective measures. Where practical and appropriate, affected users may contact Support to seek review. Nothing in this section permits whizzQ to retain amounts contrary to a Consumer's mandatory statutory rights.
29. Artificial Intelligence and Automated Features
whizzQ may use automated or AI-enabled technology for functionality including queue estimates, scheduling recommendations, marketplace recommendations, service discovery, offer recommendations, fraud detection, communications assistance and operational predictions. Automated outputs may not always be complete, current or error-free. You should not rely on an automated whizzQ output as medical advice, legal advice, financial advice, professional diagnosis or a guarantee of Merchant service availability or outcome. Where an automated booking function operates pursuant to Merchant settings, the Merchant remains responsible for maintaining accurate availability and service configuration.
30. Third-Party Services and Integrations
whizzQ may rely upon or integrate with third parties such as payment providers, messaging providers, mapping services, identity/authentication providers, app stores, Merchant systems and other external services. Third-party services may have their own terms, privacy notices, availability standards and technical restrictions. SCHEDMAD is not responsible for an independent third party's acts or omissions merely because that service is integrated with whizzQ. This does not exclude responsibility that applicable law places directly upon SCHEDMAD.
31. Intellectual Property
The whizzQ Platform, including its software, source code, interfaces, databases, algorithms, logos, trademarks, design, documentation, underlying technology and proprietary Platform content is owned by SCHEDMAD or its applicable licensors and is protected by applicable intellectual-property laws. Subject to these Terms, SCHEDMAD grants you a limited, personal, non-exclusive, non-transferable and revocable right to access and use whizzQ for lawful consumer purposes. You do not acquire ownership of the whizzQ technology through use of the Platform. Merchant names, logos and other Merchant intellectual property remain the property of the relevant Merchant or rights holder.
32. Platform Availability
SCHEDMAD aims to operate whizzQ reliably but does not guarantee uninterrupted availability. The Platform may be unavailable because of maintenance, updates, cloud-provider failure, payment-provider issues, telecommunications failure, security incidents, software errors, app-store restrictions, network failures, force-majeure events or other circumstances. Where reasonably possible, SCHEDMAD may seek to minimise material disruption.
33. Suspension and Termination of Consumer Accounts
SCHEDMAD may restrict or suspend a Consumer account where reasonably necessary because of material breach of these Terms, fraud, abusive booking behaviour, security risk, unlawful activity, payment abuse, serious harassment, repeated Platform misuse or a legal or regulatory requirement. Permanent termination should be proportionate to the circumstances. Suspension or termination does not eliminate completed transaction records, accrued obligations, valid refund rights, existing legal claims or records SCHEDMAD is required or entitled to retain.
34. Account Closure by Consumer
A Consumer may request deletion or closure of their whizzQ account through available functionality or Support. Account closure may result in loss of access to profile information, active Platform functionality, preferences, marketplace features and other account-dependent services. Certain transaction, booking, refund, fraud, tax, security or legal records may continue to be retained in accordance with the Privacy Notice and applicable law.
35. Disclaimers
35.1 Merchant Services
SCHEDMAD does not warrant the quality, suitability, professional outcome or fitness of an underlying service independently provided by a Merchant.
35.2 Merchant Information
whizzQ relies substantially on information provided or configured by Merchants. SCHEDMAD does not guarantee that every listing, price, schedule, offer, description, qualification, photograph or availability record will always be complete or error-free.
35.3 Estimates
Queue times, demand indicators, recommendations and other predictive information may be estimates.
35.4 Third-Party Systems
SCHEDMAD does not control the independent availability or processing performance of banks, payment providers, telecommunications networks or other third-party infrastructure.
35.5 Non-Excludable Obligations
Nothing in these disclaimers excludes any warranty, duty or liability that cannot lawfully be excluded under applicable Indian law.
36. Limitation of Liability
To the fullest extent permitted by applicable law, SCHEDMAD will not be liable for indirect, special, incidental or consequential losses arising solely from circumstances for which SCHEDMAD is not legally responsible. In particular, SCHEDMAD is not ordinarily responsible for losses caused solely by Merchant service quality, Merchant negligence, Merchant professional advice, Merchant premises, Merchant staff conduct, inaccurate Merchant-supplied information, Consumer misuse, unauthorised use of Consumer credentials or failures of independent third-party infrastructure outside SCHEDMAD's reasonable control. Where SCHEDMAD is legally liable for a direct loss arising from a Consumer transaction, any contractual limitation of liability will apply only to the extent permitted under applicable law. Nothing in these Terms excludes liability that cannot lawfully be excluded, limits statutory consumer remedies that cannot lawfully be waived, excludes liability for fraud by SCHEDMAD, excludes liability where exclusion is prohibited by applicable law, or prevents a Consumer from approaching an appropriate Consumer Commission or other competent statutory forum.
37. Consumer Responsibility and Indemnity for Misuse
To the extent permitted by law, you are responsible for losses directly resulting from your intentional fraud, unlawful Platform use, intellectual-property infringement, malicious technical interference, unauthorised use of third-party credentials or other material violation of these Terms. Any indemnity imposed on a Consumer under these Terms will be interpreted reasonably and subject to applicable consumer law.
38. Complaints Concerning Merchants
If you have a complaint about a Merchant service, you should ordinarily first raise the issue with the Merchant where appropriate. You may also contact whizzQ where the dispute relates to a whizzQ booking, Merchant failure to honour a booking, payment, cancellation, refund, listing integrity, fraud, abuse or another Platform-related issue. whizzQ may facilitate communication or seek information from the Merchant but does not guarantee resolution in favour of either party. whizzQ may independently take action against a Merchant under its Merchant Terms.

SCHEDMAD will seek to process grievances in accordance with applicable law.
40. Privacy
Personal Data is processed in accordance with the whizzQ Privacy Notice and applicable law. The Privacy Notice forms part of the overall legal framework governing use of the Platform. You should review it before using whizzQ.
41. Changes to the Platform
SCHEDMAD may improve, modify, replace, add, discontinue or restrict Platform functionality from time to time. Where discontinuation materially affects an existing paid Consumer transaction, SCHEDMAD will address that transaction in accordance with applicable law and the relevant refund/payment terms.
42. Changes to These Terms
SCHEDMAD may update these Terms to address legal changes, Platform changes, new features, risk or security requirements, new business models or regulatory requirements. The current version will display an effective date and/or version number. Minor changes or clarifications may be communicated through reasonable Platform notice. Where a change materially affects Consumer rights, introduces terms requiring express acceptance or relates to processing requiring fresh consent, SCHEDMAD may require additional acknowledgement or acceptance where appropriate. Continued use alone will not be treated as a substitute for fresh consent where applicable law requires affirmative consent.
43. Force Majeure
Neither SCHEDMAD nor, where applicable, a Merchant will be treated as having breached an obligation solely because performance was prevented by circumstances beyond reasonable control, such as natural disasters, government restrictions, war, civil disturbance, epidemic, major infrastructure outage, widespread telecommunications failure, banking-system disruption or similar events. This clause does not automatically eliminate any refund or consumer remedy that applicable law requires in the particular circumstances.
44. Electronic Communications and Contracting
You agree that agreements, notices and transactional records may be created or communicated electronically where permitted by law. Electronic communications may include in-app notices, emails, SMS, WhatsApp, push notifications and Platform notices. You are responsible for maintaining current contact information where necessary to receive important communications.
45. Assignment
You may not transfer your personal whizzQ account to another individual without SCHEDMAD's permission. SCHEDMAD may assign or transfer its rights and obligations in connection with corporate restructuring, merger, acquisition, financing, sale of business, group reorganisation or similar corporate transaction, subject to applicable law and continued protection of mandatory Consumer rights.
46. Severability
If any provision of these Terms is held invalid or unenforceable, the remaining provisions will continue to apply to the extent legally permitted. The invalid provision should be interpreted or modified only to the extent necessary to make it lawful and enforceable where legally permissible.
47. No Waiver
Failure by SCHEDMAD to enforce a provision on one occasion does not automatically waive the right to enforce that provision later.
48. Entire Consumer Agreement
These Terms, together with incorporated policies and transaction-specific terms presented before booking, constitute the applicable agreement concerning a Consumer's use of whizzQ. Where transaction-specific terms expressly conflict with general Terms, the more specific transaction term may apply to that transaction, subject to mandatory law.
49. Governing Law
These Terms are governed by the laws of India.
50. Jurisdiction and Statutory Consumer Remedies
Subject to applicable mandatory law, contractual disputes concerning these Terms shall be subject to the jurisdiction of competent courts at Vadodara, Gujarat, India. However, nothing in these Terms prevents a Consumer from exercising a right to approach an appropriate Consumer Commission, another statutory grievance or adjudicatory forum, a regulator or another competent authority where such right is provided by applicable law and cannot validly be excluded by contract.
